But, it was not famous former boxer Mike Tyson who was bothered with the tattoo being copied, but the tattoo artist who created Mike’s distinctive facial tattoo. And he is actually the person who decided to file a lawsuit against Warner Bros. for the use of his work on “The Hangover: Part II.” S. Victor Whitmill claims that they the producers of the film had no right to copy his tattoo design. However, probably the case will be settled after all, as the two parties will most likely reach an agreement.
In the movie, Ed Helms wears the tattoo, thing that according to the artist is unlawful, as he copyrighted the design. Tyson got the tattoo back in 2003 and the artist claimed that since then no one else used the design, as he never allowed it. “When Mr. Whitmill created the Original Tattoo, Mr Tyson agreed that Mr. Whitmill would own the artwork and thus, the copyright in the Original Tattoo,” the lawsuit papers mentioned. However, now it seems that the movie producers violated his copyright and used the designer for the comedy. “This unauthorized exploitation of the Original Tattoo constitutes copyright infringement,” the artist argues in the lawsuit papers that have already been filed in court. And what S. Victor Whitmill is seeking now is for the scenes including his design to be removed from the movie, also asking for a sum of money, under a settlement agreement attempt that has not been made public at this point. No comments on the case have been made by reps for Warner Bros.
