Australia’s plan to send asylum-seekers from Malaysia back was postponed after a court prevented on Monday the transfer of 16 people from Christmas Island to Kuala Lumpur. The plan to expel 800 people is to be reevaluated by a further hearing of the court in two weeks.
The case was made by lawyers of 16 people who were expected to be the first ones to be taken from Christmas Island and send back to Malaysia. In their statement, the lawyers made the argument that the state had no right to send these people overseas.
They said that the claim of their clients should be considered in Australia, in stead of being deported back to Malaysia.
The Immigration Minister said that Australia is committed to the extradition plan and may demand that the hearing be conducted before August 22, adding that his government expected this plan to be challenged.
The decision of the court is a serious blow to Julia Gillard’s “Malaysia Solution,” by which she wanted to send back to Malaysia 800 asylum seekers and to receive in exchange 4,000 certified immigrants over four years.
The plan was aimed at fighting people smuggling and had as an important component the loading on the Internet of videos showing the asylum seekers being embarked on the ships that would take them back to where they came from.

By this plan, Gillard’s cabinet was expecting the people of Malaysia to get the clear message that if they trusted people smugglers to take them to Australia they would end up back in Malaysia.
The Australian government’s plan comes as a result of many accidents that happen in the region of the Christmas Island, where people drown as their frail vessels hit against the rocks.
Violent incidents happened early in the year in the detention camps in the Christmas Island, prompting the police to intervene with riot gear on.
Human rights associations have criticized the governmental plan since it was announced by Julia Gillard as a breakthrough a few months ago.
