The article 8 paragraph 2 b which states that the Electricity Basic Tariff or TDL will still be applied in 2011 was caused by human error. Apparently, the draft legislation was stored in the computer memory of the Secretary Parliament and was not removed when the final draft presented to the House.
“This (the inclusion of article 8 paragraph 2 b in the Draft State Budget 2011) occurred because of human error. So do not interpret this as a deliberate tactic to include the chapter,” said the House Budget Committee Chairman, Melchias Markus Mekeng in Jakarta, Wednesday (27/10/ 2010).
According Melchias, the Parliament computer saved the whole body of the proposed state budget bill. This particular clause should have been deleted, but instead the officials only either insert or modify other articles and left the particular clause untouched.
“When the discussion 2011 draft state budget is completed, employees just do the insert new data in the state budget bill. The article 8 however, should have been removed, but it did not. It happened by pure accident,” he said.
Melchias reaffirmed that there is no electricity increase in 2011. In addition, 2011 budget also allocates additional electricity subsidy due to the cancellation of the increase. “Our decision is clear, and I already said it that there is no increase in electricity price. Let not make this as if this is deliberate,” he said.
Earlier, Finance Minister Agus Martowardojo said the existence of article 8, paragraph 2b in the 2011 state budget bill was a mistake by technical teams from the Finance Ministry and the House Budget Agency who missed the articles in the previous budget discussion.
“The discussion started with the draft of 2011 state budget bill with Budget Committee. There were four working committee formed to tackle each section of the draft. The longest discussion was the technical teams so when the bill was recombined again, some of the changes were missed” he explained.
Agus Marto insisted there was no covert intention from the government regarding the appearance of the article. His ministry has agreed not to raise electricity tariff in 2011.
“There is no intention to reintroduce the chapter. The Budget Committee has agreed with the meeting between Commission VII and the Government, everyone has agreed not to increase the tariff. So that clause is just missed by the technical team,” he explained.
Agus has agreed to remove the article of the State Budget Law 2011. “It was missed, but has been corrected for on-delete, and agreed to be removed,” he said.
