Two Indonesian men who were nabbed for selling iPad through internet forums is being tried the Central Jakarta District court. The police accuse the men of illegally selling the iPad without proper manual and permits.
The case has attracted a lot of attention recently especially in many internet forums and social network sites. Many questioned the arrests and thought that the act was pretty harmless.
The case began when Dian Yudha (42 years old) and Randy (29 years old) offers two iPad 3G Wi Fi 64 GB in the largest Indonesian forum www.kaskus.us. The men tell a story that they have bought the iPad in Singapore on their last trip and now they intended to sell it.

The buyer turns out to be a Metro Jaya Police officer who at that moment was conducting a sting operation into the sales of illegal Ipad. The undercover officer completed the transaction off line at City Walk, Tanah Abang, Central Jakarta on December 24, 2010 and nabbed the two man at the scene.
They were later named as a suspect and were charged with violating Article 62 Paragraph (1) in conjunction with Article 8 Paragraph (1) letter j of Law No. 8 of 1999 on Consumer Protection for selling electronic device without manual in Indonesian language.
In addition they were also charged with Article 52 in conjunction with Article 32 Paragraph (1) of Act No. 36 of 1999 on Telecommunications since iPads had not been categorized as an official electronic communication. The article carries a prison term of 5 years.
The Public outcry was so loud that the Metro Jaya Police finally held a press conference on Sunday (07/03/2011) to explain the situation.
Head of Public Relations Jakarta Police Commissioner Baharudin Djafar, explained that this iPads investigation began with the release of IPAD in 2010 when it started to boom. According to Baharudin, many iPad were illegally traded prompting the Special Criminal Investigation Directorate (Ditreskrimsus) Polda Metro Jaya to initiate a criminal investigation.
“We were hoping to uncover just who was importing these unregistered goods and who were the perpetrators of this illegal trade,” said Baharudin.
The Police said the first iPad circulated in Indonesia did not have permission from the Directorate General of Post and Telecommunications. In addition, they also did not have manual in Indonesian language. These are the same two reasons use as a basis for the law enforcement officers to make the arrests of Dian and Randy.
The police insisted that they were selling these iPads illegally. The Police inquiry and investigation process is backed up by expert witnesses from the Directorate General of Post and Telecommunication and the Ministry of Commerce.
The Police questioned the claim that the two men bought the iPads in Singapore. The Head of Industry and Commerce Polda Metro Jaya Nugroho AKBP Sandy explains that the two men admitted to have purchased the iPad from a seller “as is” in Singapore.
“But when asked who the seller was, he could not say. He said he doesn’t know the seller which is weird for someone who is buying a lot of these iPads” Sandy said. According to Randy he had sold 12 of these iPads.
Furthermore, Randy also failed to show his passport to prove that he had been to Singapore to buy the iPads. The two men are not currently being detained.
